These Payment Terms are an addendum to the Terms and Conditions, which the user at MySafetyEye ApS (Hereinafter "MySafetyEye") must accept in order to purchase MySafetyEye products and/or access the service.
MySafetyEye’s Payment Terms are not relevant for users with a “Free subscription” as there is no fee or payment.
The user must process the payment for paid subscriptions and products via MySafe-tyEye’s offered means of payment. MySafetyEye accepts online payments with Visa, Mastercard and American Express. Payment will be deducted from your account when the product or virtual product, including the MySafetyEye service, is ordered, unless otherwise agreed or stated in your order as for instance after a trial period.
All prices on the website are inclusive of freight and VAT. The MySafetyEye app uses the following currencies for pricing Denmark - Kroner (DKK).
MySafetyEye uses a secure payment server that encrypts all information with SSL protocol, which means that your data is secure and cannot be read by other outsiders. The payment server is provided by the Danish payment provider Stripe Inc., 510 Townsend Street, San Francisco, CA 94103, USA, which stores all purchase data and payment information securely and fully protected and meets all requirements for PCI Compliance.
Subscriptions are automatically renewed until the user use the right of withdrawal, terminate or cancel the subscription. Payment is processed automatically in advance as a subscription scheme. The prepaid period of the subscription scheme is chosen either as monthly or yearly payments respectively from the day of creation. On first payment, the user signs and authorizes the subscription payments, which are debited in advance on the subscription date for the entire subscription period.
At each payment date, the user guarantees to have sufficient means of payment available via the chosen means of payment. However, if the payment transaction is rejected, the payment subscription is terminated immediately. In this case the sub-scription can be renewed by re-purchasing the subscription via the app, which may be necessary when, for example, the credit card expires.
Fees are the subscription price for using the service and must be paid according to the current price list available on the website and in the MySafetyEye app.
MySafetyEye reserves the right to change the fee as well as other terms of service in accordance with the Payment Terms as well as the Terms and Conditions. The change must be notified to the user no later than 30 days before the change takes effect.
In the event of such changes, the user is entitled to cancel the subscription with effect from the day the change takes effect. If the user does not cancel the subscription before the change takes effect, this is considered acceptance of the change. Changes that are clearly to the benefit of the user apply immediately without any right of termination for the user. At each payment date, the user guarantees to have sufficient funds available via the chosen means of payment.
If the user has signed up for a subscription with monthly payment, the user can ter-minate the subscription at any time with 1 months’ notice to the end of a month. For instance, if the user terminates his or her subscription on May 15th, 2021, the subscription will expire on June 30th, 2021.
If the user has signed up for a subscription with an annual payment, the user can terminate with 1 months’ notice with effect from the end of the month where the subscription with the annual payment expires. In this regard, the subscription expires on the day of completion for next subscription renewal. For instance, if the user paid for the annual subscription on May 15th, 2021, and the user hereafter terminates the subscription during the subscription period, the subscription will not expire until May 15th, 2022. To avoid subscription renewal, the user must notify termination no later than 1 month before the renewal, which in above-mentioned example entails notice of termination no later than April 15th, 2022.
As a user, you have access to use your subscription until the end of its termination. To terminate the agreement, the user must notify this per e-mail to firstname.lastname@example.org. The user will receive a confirmation of the completion of the termination. If there is any doubt as to whether a subscription has been terminated. It is the user's responsibility to prove that he or she has terminated the subscription.
MySafetyEye’s termination and suspension
MySafetyEye reserves the right to suspend the user access and terminate the mobile app subscription service at any time. MySafetyEye can terminate a user’s subscription with 1 month notice.
If the user significantly violates his or her obligations in accordance with the Terms and Conditions, MySafetyEye may even terminate a subscription with immediate effect. Significant violations will, for example, consist of the user's lack of punctual payment or late payment of an amount due, however is not limited to these examples.
Fees for purchases of MySafetyEye virtual services are non-refundable, which means that MySafetyEye does not refund nor credit for ongoing subscription periods. During the notice period, the user maintains access to the service until the end of the subscription.
Physical goods will be refunded according to the Danish Consumer Contracts Act, where you have a 14-day right of withdrawal after receipt of the goods. It is a condi-tion of the refund that the item is in the same condition as well as in original and intact packaging. If an item is returned, damaged or appears used in a way that impairs the value of the item, we reserve the right to reject the return and refund.

MySafetyEye reserves the right to make changes to these Payment Terms from time to time due to changes or requirements in applicable law, new app features or changes in business practices.
MySafetyEye publishes the latest version of Payment Terms at www.mysafetyeye.com as well as on the app. We recommend that you check the latest version regularly, as this constitutes the applicable conditions. If you continue to use the service after the changes have taken effect, you accept these changes and thus the new Payment Terms.
Notwithstanding the foregoing, you are responsible for complying with the updated terms published online at www.mysafetyeye.comeven if these updated terms appear on MySafetyEye's website before they are published on the app.
If the changes include significant changes to your rights or obligations, MySafetyEye will notify you of the changes 30 days before they take effect by email, through the Service or the website, unless applicable law prevents such notice.
